Together, they explore the challenges of personal injury cases, common misconceptions about insurance companies, and why having a knowledgeable attorney is crucial when dealing with an injury claim.

00:00 Narrator: Welcome to Peachtree Injury Talk with attorney Jordan Jewkes.
00:06 Kevin Rosenquist: Hello and welcome to Peachtree Injury Talk with attorney Jordan Jewkes. I'm your host, Kevin Rosenquist, and today we're diving into the essentials you need to know about personal injury law in Georgia. Jordan, thanks so much for joining us today.
00:18 Jordan Jewkes: Thanks for having me, Kevin. We appreciate it.
00:20 Kevin Rosenquist: So tell me, what interested you in practicing personal injury law? Why do you feel these cases are important?
00:27 Jordan Jewkes: Gosh, let me start back in my background a little bit. I came out of law school and joined an insurance defense firm in Atlanta—one of those firms located in a big high-rise downtown. I thought that’s what I wanted to do: work for the insurance company, had a decent salary, was checking a lot of the boxes. But I realized pretty quickly that the insurance companies really didn’t care about the people who got injured. In fact, their pattern and policy was to minimize injuries and avoid fairly compensating legitimately injured people. We really didn’t see many fake claims—most of the people filing claims were genuinely hurt. At some point, I realized that what I was doing didn’t align with my personal moral compass. So I switched to representing injured individuals. And honestly, the best part is just being able to help people—people who’ve been in a car wreck or injured through no fault of their own. Sometimes they don’t have a lot of options, and we get to help them get the medical care they need and a settlement that helps improve their lives. That’s why I love what I do—helping people day in and day out. It’s awesome.
02:02 Kevin Rosenquist: That’s interesting, because I’ve heard that sentiment before from other personal injury attorneys who started on the insurance side and said, “Yeah, I didn’t feel good about it, so I switched.” Seems like there’s a pattern of people realizing the insurance companies are mostly about their bottom line.
02:24 Jordan Jewkes: Yeah, exactly. The insurance companies and their law firms recruit heavily out of law school. They go after the top students, so it’s easy to get pulled in and trust what they’re saying. But when you really look at it, they don’t have the injured person’s best interests at heart. And sometimes it’s your own insurance company working against you. In a perfect world, you wouldn’t need insurance—or attorneys to do what I do. But that’s not reality. So it’s important to have someone who can advocate for you through the process.
03:07 Kevin Rosenquist: There are a lot of misconceptions about personal injury cases and attorneys. What are some of the common ones you hear?
03:15 Jordan Jewkes: Yeah, tons of misconceptions. Probably the most common is that you can trust the insurance company. They’ll say, “Tell me if you’re injured, tell me what happened.” They record those calls, and they will use them against you if it turns out you're more injured than you first thought. We get a lot of calls from people who initially believed their insurance company would take care of them. Two weeks—or two months—later, they’re saying, “They’ve stopped returning my calls,” or, “They’re telling me to stop treatment.” That’s a big one: even your own insurance company may not be on your side. Another one is that a quick settlement is a good thing. Sometimes it is, but more often, a quick settlement benefits the insurance company. They want to get out cheap before the injury turns out to be more serious. Most people don’t know the full extent of their injuries right away—it can take multiple doctor visits or even seeing a specialist. Insurance companies don’t like that, so they try to rush a settlement, which is usually not in your best interest.
04:55 Kevin Rosenquist: Do you find that people often want to handle cases on their own?
05:02 Jordan Jewkes: Absolutely. And that’s not necessarily bad—especially here on the south side of Atlanta, folks will try to handle it themselves. We even put out a lot of content to help people who want to go that route. But the insurance companies love that. Unless you have a legal background or have done a ton of research, it’s tough to go up against them. If you’ve got any significant injury, you really need a competent attorney. The insurance company has defenses, tactics, traps—they know what they’re doing. You need someone who knows how to push back.
05:48 Kevin Rosenquist: If you're an average person with a lot of experience in this, something's probably going wrong in your life.
05:55 Jordan Jewkes: Right—if you’ve got that much experience, you’ve had some bad luck behind the wheel or something else!
06:01 Kevin Rosenquist: Don’t walk through construction sites. So walk me through a typical personal injury case. Where does it begin and end?
06:07 Jordan Jewkes: Great question. A typical case—let’s say a car wreck—starts at the moment of impact. After that, you need to get medical treatment, but you also need to start documenting everything: the police report, photos, your injuries. The progression of a claim is mostly driven by how bad the injuries are and what treatment is required. Minor injuries might resolve in weeks or a few months. More serious cases—ones that require surgery or involve permanent damage—can take years. Generally, six months to a year is a good average. But Georgia has a two-year statute of limitations, so sometimes we have to file a lawsuit even before someone’s done with treatment, just to preserve the claim. Once treatment is complete, we gather medical records and put together a demand package for the insurance company. That outlines the law, your injuries, and why the company should pay. Then we negotiate from there. That’s the typical path.
08:11 Kevin Rosenquist: What types of damages are recoverable in Georgia?
08:16 Jordan Jewkes: Georgia actually has great laws on this—some of the best. You're allowed to recover pain and suffering, past and future medical bills, and past and future lost wages. There are some other technical categories, but those are the major ones. If a doctor says, “You’re going to need this surgery,” and you say, “Maybe not right now, but next year,” we can still include the cost of that future surgery in your claim. And if you’ve missed work or can’t continue working, we get documentation to show your lost income. All of that falls under what we call compensatory damages.
09:30 Kevin Rosenquist: I’ve always wondered—how do people pay their medical bills while a case is ongoing? That seems like it could be tough before a settlement comes in.
09:45 Jordan Jewkes: That’s a huge concern, and a big reason why some people avoid treatment altogether. Hopefully, you have health insurance—if so, use it. But if you don’t, most people don’t have cash on hand to pay up front. The good news is that in Georgia, there are excellent doctors willing to treat patients on a lien, which is basically a tab. They’ll treat you now and get paid out of the settlement later. We’ve got great relationships with those doctors, and they trust our firm enough to wait to be paid. Even if you need something serious—like back or neck surgery—we can usually find someone qualified who’ll treat you and get paid once your case resolves.
10:55 Kevin Rosenquist: That’s really cool. So they trust that you’ll make sure they get paid?
11:03 Jordan Jewkes: Yeah, that trust is a huge part of it, absolutely.
11:06 Kevin Rosenquist: What are some common mistakes people make that can hurt their case?
11:12 Jordan Jewkes: One of the biggest ones is talking too much to the insurance company right after the accident. We tell our clients: don’t discuss your injuries with the insurance adjuster. You often don’t even know the full extent until you’ve seen a doctor. They record those calls, and later they’ll say, “You told us your back didn’t hurt,” even if it starts hurting days later and turns out to be a herniated disc. Another common mistake is delaying medical treatment. Especially guys—they’ll say, “I’m fine, I’ll tough it out.” That’s admirable, but not wise in this context. If you wait two or three weeks—or worse, months—to get care, the insurance company will argue you weren’t really hurt. No “gaps in treatment”—that’s the key. Follow the doctor’s advice and be consistent.
13:04 Kevin Rosenquist: That makes sense. You’re probably still full of adrenaline after a wreck and might not realize how hurt you are.
13:19 Jordan Jewkes: Happens all the time. We’ve got great over-the-counter medications, hot tubs, all that—but if you’re really hurt, sometimes the pain doesn’t hit until a few days later. Just because you didn’t go to the ER right after the crash doesn’t mean you’re not seriously injured.
13:51 Kevin Rosenquist: Final question—what sets The Jewkes Firm apart in how you handle cases?
13:55 Jordan Jewkes: A lot of firms out there just want a quick settlement. There are good attorneys too. But what sets us apart, I think, is my background working for the insurance companies. I know how they analyze cases, what weaknesses they look for, and how they approach negotiations. That gives us an edge. The other big thing is how we treat our clients. We really take that “clients are family” approach. We try to know our clients by name, learn about their kids, return their calls, and treat them the way we’d treat our own family. Most people don’t want to go through this process—it’s often the first time they’ve needed an attorney. So we try to make it as smooth and supportive as possible.
